1. Service Overview and Meta Disclaimer

DM Turbo is an independent automation, marketing, and customer support platform that provides features including Instagram DM and comment automation, form creation, SMS campaigns, and AI-powered responses.

We operate using official APIs; however, we are not affiliated with, sponsored by, or endorsed by Meta Platforms Inc., Instagram, or Facebook. Users acknowledge that DM Turbo’s functionality depends on the availability and performance of Meta’s APIs, which may be subject to interruptions, limitations, or changes without prior notice.

2. Acceptable Use and Prohibited Activities

Users agree to use DM Turbo in compliance with all applicable laws and in an ethical manner. The following activities are strictly prohibited:

• Sending spam, unsolicited bulk messages, or engaging in harassment of other users.
• Violating Meta’s or Instagram’s Terms of Use, or any applicable data protection laws (including the LGPD).
• Using the platform to facilitate illegal activities, scams, or fraudulent schemes.
• Attempting to reverse engineer, compromise, hack, or interfere with DM Turbo’s servers or systems.

Any violation of these rules may result in immediate account suspension or termination, without prior notice and without eligibility for a refund.

3. AI, SMS, and Lead Responsibilities

Artificial Intelligence (AI): Our system uses AI to generate responses. AI-generated responses may occasionally be inaccurate, incomplete, or incorrect. Users are solely responsible for configuring, monitoring, and reviewing any responses sent to their customers.

SMS and Communications: Users are solely responsible for ensuring they have obtained all required legal consent (opt-in) from their customers before sending SMS campaigns or automated communications through our platform.

4. Subscriptions, Payments, and Refund Policy

We offer users the opportunity to try our platform. Once a paid plan is purchased and activated, subscriptions will automatically renew unless canceled by the user.

Under Article 49 of the Brazilian Consumer Protection Code (CDC), users may request cancellation and a full refund within 7 calendar days of their first purchase. After this 7-day period, payments already made are non-refundable, including full or prorated amounts. Cancellation will only prevent future charges from being applied.

5. Limitation of Liability

To the fullest extent permitted by law, DM Turbo shall not be liable for:

• The suspension, shadowban, or deletion of Instagram accounts by Meta.
• Any loss of profits, data, or sales resulting from technical failures or temporary system interruptions.
• Any damages arising from messages sent through automation or AI to the user’s customers.

6. Governing Law and Jurisdiction

These Terms shall be governed by the laws of the Federative Republic of Brazil. Any disputes arising out of or relating to these Terms shall be resolved in the courts of the city where DM Turbo is headquartered, and the parties hereby waive any other jurisdiction that may otherwise apply.
